The positive duty to actually
deliver the SDS
Regulation 339 of WHS Act, as clarified in the Managing
Risks of Hazardous Chemicals (doc 697), states
The supplier must provide the current
safety data sheet for the hazardous chemical when the
chemical is first supplied to the workplace and if the
SDS is amended.

The
requirement to make certain information
available to
workers / staff
Regulation 344 of WHS Act referenced from Managing Risks of Hazardous Chemicals (doc 697)
requires the person conducting a business or undertaking
to ensure the current SDS is readily accessible
to workers who use the hazardous chemical at the
workplace and an emergency service worker, or anyone
else, who is likely to be exposed to the hazardous

The conditions under which an
SDS must be updated
The WHS Act indicates requires the person conducting a
business or undertaking to ensure that the SDS they hold
for each hazardous chemical is not more than 5 years
old. Further the WHS Act Model Codes of Practice
requires that the SDS must be reviewed, by the author, every five years from the date of
original preparation or the last revision of the SDS. It must
also be
amended whenever any new information about the hazardous
chemical is known or received or when the formulation changes.
